Terms of Service

1. Overview

ByModel ("we," "us," "our") operates an invitation-only marketplace at bymodel.io where buyers purchase exclusive AI influencer characters. These Terms of Service ("Terms") govern your use of our website, services, and any content purchased through the platform. By accessing or using ByModel, you agree to be bound by these Terms.

2. Eligibility

You must be at least 18 years old to use ByModel. By creating an account or making a purchase, you represent that you meet this age requirement and have the legal capacity to enter into a binding agreement.

3. Accounts

An account is required to make purchases. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at hello@bymodel.io if you suspect unauthorized access.

4. Products & Exclusivity

Each AI character listed on ByModel is sold exactly once. Once purchased, the character is permanently removed from the marketplace. The buyer receives an exclusive, perpetual content pack including images, videos, captions, and tags. No other person will receive the same character or content pack.

5. What You Receive

Each purchase includes a complete content pack: feed photos, reels/TikToks, stories, and premium/exclusive content. All assets are organized, tagged, and captioned via AI and accessible through your Content Library.

You receive a perpetual, non-transferable license to use the purchased content for commercial purposes on social media platforms including but not limited to Fanvue, OnlyFans, Instagram, and TikTok.

6. What You Do NOT Receive

You do not receive the underlying AI model, LoRA training weights, or any generation capabilities. ByModel retains all rights to the AI model used to create the character.

You may not resell, redistribute, sublicense, or make available the purchased content to third parties as a standalone product. You may use the content to build and monetize social media accounts.

7. Pricing & Payments

All prices are listed in USD. Payments are processed securely via Stripe. ByModel absorbs all payment processing fees — the price displayed is the price you pay.

An account is required to complete a purchase. Payment is due at the time of purchase.

8. Refund Policy

Due to the digital and exclusive nature of our products, all sales are final once the content pack has been accessed or downloaded. If you experience technical issues preventing you from accessing your purchase, contact hello@bymodel.io within 24 hours and we will resolve the issue or issue a refund at our discretion.

9. Content Library & Access

Purchased content is permanently accessible through your Content Library for as long as you maintain an active account. There is no download expiry. We reserve the right to suspend access to accounts that violate these Terms.

10. Seller Terms

ByModel operates on an invitation-only basis for sellers. Sellers are independent creators who upload AI character content packs for review. All submissions are subject to admin approval before being listed.

Sellers earn 75% of each sale. Payouts are processed after a 5-day hold period. Sellers may also earn referral commissions (10%) for referring other sellers to the platform.

Sellers retain no rights to content once a character is sold. By uploading content, sellers grant ByModel the right to display, distribute, and deliver the content to buyers.

11. Affiliate Program

Affiliates earn commission (15–30%, set by ByModel) on sales made through their referral link. Attribution uses a 30-day cookie window with last-click attribution. Payouts are processed monthly with a minimum $50 threshold. ByModel reserves the right to modify commission rates or terminate affiliate accounts at any time.

12. Prohibited Use

You may not use ByModel or purchased content to: create or distribute content depicting minors; engage in fraud, harassment, or illegal activity; reverse-engineer AI models; or circumvent platform security measures.

Violation of these terms may result in immediate account termination without refund.

13. Intellectual Property

All platform content, branding, design, and code are owned by ByModel. Purchased character content is licensed to the buyer under the terms described in Section 5 and 6. ByModel retains ownership of all AI models and LoRA weights.

14. Limitation of Liability

ByModel is provided "as is." We make no warranties regarding the fitness of purchased content for any particular purpose. Our total liability to you shall not exceed the amount you paid for your most recent purchase. We are not liable for indirect, incidental, or consequential damages.

15. Changes to Terms

We may update these Terms at any time. Continued use of ByModel after changes constitutes acceptance. We will notify registered users of material changes via email.
